GENERAL TERMS AND CONDITIONS

OF THE HANSEATICUM CENTER FOR PLASTIC AND AESTHETIC SURGERY, MARTINISTRASSE 64, 20251 HAMBURG

THE HANSEATICUM-WEST, CENTER FOR ORTHOPEDICS AND TRAUMA SURGERY, SURGERY, HAND AND PLASTIC-AESTHETIC SURGERY, JÜRGEN-TÖPFER-STRASSE 46, 22763 HAMBURG


- hereinafter referred to as HANSEATICUM -

§ 1 GENERAL PROVISIONS

(a)    The following General Terms and Conditions are part of all contracts between patients/clients and the HANSEATICUM. They also apply if the HANSEATICUM has services provided by third parties, as well as for any subsequent examinations and treatments.

(b)    Deviating General Terms and Conditions of contractual partners will not become part of the contracts.

(c)    Side agreements between the HANSEATICUM and the patients/clients are only valid after written confirmation by the HANSEATICUM.

(d)    Oral statements by the HANSEATICUM are fundamentally non-binding.

(e)    This is a complementary translation of our German Terms and Conditions. In case of deviations of the German version of these Terms and Conditions from the English version the German version shall prevail.

§ 2 BUSINESS RELATIONSHIPS

The business relationship is based on a signed treatment fee contract or other agreements within the framework of diagnostics and therapy (for example, appointment agreements) between the HANSEATICUM and the patients/clients.

§ 3 REGISTRATION AND APPOINTMENTS

(a)    Appointments are made in person, by telephone, or by email.

(b)    The patient is bound to the agreed appointments and times. If an appointment cannot be kept for an important reason, the patient must notify this at least 24 hours before the agreed appointment in person, by telephone, or by email. If the patient/client does not meet this deadline, the HANSEATICUM may charge the patient/client for the cost of the missed appointment, provided the appointment cannot be allocated to someone else.

(c)    The HANSEATICUM itself strives to keep the agreed appointments and times. Changes for medical-organizational reasons are reserved and will be communicated to the patient as soon as possible. Insofar as the HANSEATICUM has to postpone or cancel an agreed appointment, no reimbursement claims of the patient/client against the HANSEATICUM result from this.

§ 4 MEDICAL HISTORY FORM 

The patient/client receives a medical history form at the first presentation. This must be filled out carefully and truthfully by the patient/client and handed over to the HANSEATICUM signed.

§ 5 PAYMENT TERMS AND ADVANCES

(a)    A consultation fee according to the GOÄ (German Fee Schedule for Physicians) is charged for medical advice by the HANSEATICUM. The HANSEATICUM is legally obliged to do this. Free consultations are prohibited for the HANSEATICUM.

(b)    Statutory and private insured patients/clients receive an invoice for their consultation, which is based on the GOÄ. Statutory insured patients/clients are advised that they cannot submit this invoice to their health insurance.

(c)    An honorarium agreement for a corresponding service is concluded between the HANSEATICUM and the patient/client. The patient/client undertakes to transfer the amount set in the honorarium agreement without deduction, observing the deadline indicated on the invoice, to the account of the HANSEATICUM. Alternatively, the amount can also be paid in cash or by EC card. This applies regardless of any reimbursement by the private health insurance.

(d)    Cost estimates for non-medically indicated procedures are valid for six weeks from issuance. After this period, the patient/client no longer has the right to the price quoted in the cost estimate.

(e)    The patient/client is aware that the HANSEATICUM performs surgical services in the premises of third parties. A surgery request to a corresponding clinic is made by the HANSEATICUM only after a treatment contract with the patient/client has been concluded. The patient/client receives an advance invoice for the associated costs, e.g., the cost of OR rental. The patient/client must transfer the invoice amount resulting from the advance invoice to the HANSEATICUM to secure the surgery appointment at the latest 2 weeks before the planned procedure, alternatively pay in cash or by EC card.
   
(f)    If the patient/client has to cancel a surgery due to illness or decides against carrying out the planned surgery for other reasons, the cancellation must occur at the latest 6 working days before the surgery date, otherwise the advance payment made according to § 5 (e) cannot be refunded to the patient/client, as the HANSEATICUM incurs costs from third parties (e.g., costs of OR rental).

§ 6 VOLUNTARINESS AND COOPERATION

(a)    The consultation and treatment by the HANSEATICUM are carried out solely at the request of the patient. All services and therapies provided by the HANSEATICUM are carried out in consultation with the patient/client.

(b)    The patient/client is obliged to answer all questions about his person, especially those concerning his health and previous therapy course, comprehensively and truthfully, or to provide important information for the treatment independently.

(c)     The HANSEATICUM is entitled to terminate the treatment of the patient/client up to the intended surgery date if the trust relationship is no longer given, especially if the patient/client refuses therapy measures, provides incorrect or incomplete information about the medical history and diagnosis, or thwarts therapy measures.

§ 7 LIABILITY

(a)    The HANSEATICUM assumes no liability for theft or loss of personal items of the patient/client. This also applies if the services are provided outside the premises of the HANSEATICUM.

(b)    The liability of the HANSEATICUM for damages not resulting from injury to life, body, or health is excluded if the damage is due to merely negligent breach of duty by the HANSEATICUM.

§ 8 FOLLOW-UP COST INSURANCE

The patient/client is advised that it is possible to take out follow-up cost insurance for non-medically indicated treatments.

§ 9 DATA PROTECTION

The HANSEATICUM uses computer-supported data processing for administration. Personal billing-related data of the patient/client are recorded, stored, and archived.

§ 10 TRANSFER OF PATIENT DATA

The HANSEATICUM informs the patient/client that data is partially forwarded to a billing institute for billing purposes. The patient/client of the HANSEATICUM consents to the forwarding of his data to the billing institute.

§ 11 SEVERABILITY CLAUSE

Should a provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
